This Agreement is between you and Wilburn Pacific Company("we", "us"), and it covers Nebula, the optional cloud filtering service for SpamBlaster. It applies when you use Nebula. If you do not use Nebula, it does not apply to you.
Nebula is a service. SpamBlaster itself is software, and it is covered separately by the End User License Agreement. Nebula includes Vortex, the sync service, which has its own Vortex Service Agreement; where the two agreements say different things about the same data, this one governs while you use Nebula, and the difference is deliberate and set out below.
1. What Nebula does, and what that means
SpamBlaster Nebula is your cloud-based SpamBlaster. We operate a filtering node in Microsoft's datacenters that connects to your authorized mailbox, scanning it 24/7 and applying your rules exactly like the SpamBlaster desktop software. It exists so that you can have an always-on filter without an always-on computer, and manage your rules from a browser or a phone.
To filter your mail, your SpamBlaster Nebula node must have access to it. By authorizing a mailbox, you grant SpamBlaster Nebula the same permissions as your local SpamBlaster: to read, move, or delete messages based on your rules. For Gmail, Microsoft, and IMAP accounts that utilize app passwords, you can control this access directly through your mail provider and can revoke it at any time.
Your SpamBlaster Nebula node holds access to your SpamBlaster Vortex when connected. If you have SpamBlaster devices and a SpamBlaster Nebula node connected to your SpamBlaster Vortex, those devices and the node hold the same keys used to access your SpamBlaster Vortex data. Your rules, safelist and blocked-mail history are accessed by the SpamBlaster Nebula node in order to provide filtering and to keep the node in sync with your devices.
No SpamBlaster employee can browse your mail. We say this as a description of how the service is built rather than as a policy. Your SpamBlaster Nebula node runs with no interactive access for anyone, including us. The storage is encrypted under a key that only the running service can obtain and its logs are built to explicitly exclude message content. What we can and cannot see, and how each of those is enforced, is set out in our Privacy Policy, which we have written to be specific rather than reassuring.
2. Eligibility
Nebula requires an active Nebula plan, a SpamBlaster account, and a mailbox with a provider we support. You are responsible for the mailboxes you authorize, for having the right to authorize them, and for keeping your account sign-in secure.
3. Your rules act on your mail
SpamBlaster Nebula acts only on rules you made. When it notices mail in your Junk folder that no rule caught and may be spam, it may suggest that mail as spam in the SpamBlaster Nebula dashboard. Nothing happens to the mail unless you Blast it, which makes rules the same way the Blast button in your mail client does. Nothing in SpamBlaster Nebula moves or deletes mail on its own judgement. If you set a rule to delete rather than quarantine, deleted mail is gone the way deleted mail is gone at your provider, and we cannot restore it.
4. What we store
Your SpamBlaster Nebula node stores the credential your provider issues for the mailbox you authorized, your rules, safelist and blocked-mail history, and a small amount of working data about mail no rule caught, including the sender and subject of the few messages it suggests as spam, all in encrypted storage. Our Privacy Policy describes each item, how long it is kept, and who hosts it, in one place on purpose, so that the two documents cannot come to disagree.
5. Availability
We provide Nebula on a reasonable-efforts basis. We do not promise any particular level of availability, and we may perform maintenance, change how the service works, or interrupt it. Mail that arrives while your node is unavailable is filtered when it returns; it is not lost, because your node only ever acts on mail your provider already holds.
We may discontinue Nebula. If we do, we will give reasonable notice and a period in which you can move your rules to the SpamBlaster software on your own computer, which is the same product with the other posture.
6. Acceptable use
Nebula is for filtering mailboxes you are entitled to filter. Do not authorize a mailbox that is not yours to authorize, do not attempt to disrupt the service or reach another customer's node or data, and do not use it to break the law. We may suspend accounts that do.
7. Cancellation, termination and your data
- You can stop at any time. Cancelling your plan is described in section 9 of the End User License Agreement, which covers payment, renewal and refunds for everything we sell. Revoking your node's mailbox authorization at your provider stops it at once, whatever your plan says.
- What stops, and when. When your plan ends, your SpamBlaster Nebula node stops scanning at its next pass. For thirty days after that, a renewed plan picks up where it left off; nothing is deleted in that time.
- What we delete.Thirty days after your plan ends, when you request to have your data deleted, or when you delete your account, we will then delete your SpamBlaster Nebula node's data, including the mailbox credential it held. If you also used Vortex, its data is deleted on the same schedule under that agreement.
- We may suspend or end your access if you materially breach this Agreement. Where the breach is something you can fix, we will say so first if it is reasonable to do that.
8. Disclaimer
Nebula is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will catch every unwanted message or leave every wanted one alone.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost mail, or the cost of substitute services. Our total liability arising out of or relating to Nebula is limited to the amount you paid us for Nebula in the twelve months before the claim arose.
Some jurisdictions do not allow certain limitations, in which case those limitations apply only as far as the law allows.
10. Governing law
This Agreement is governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules.
11. Changes
We may update this Agreement. If a change materially reduces your rights or materially changes what we do with your data, we will give notice before it takes effect, and continuing to use Nebula after that means you accept it. The date at the top of this page always reflects the current version.
